Introduction

1.1 Contract

“PoliticalMeetings.com LLC” has Customers, and they are Political Entities as listed below under the Terms and Conditions. Subscribers of the PoliticalMeetings.com “PM Platform” subscribe to search and locate Political Entities nationwide.  A Subscriber is defined as an individual who subscribes to the PoliticalMeetings.com database for the purpose of accessing one or more calendars and other data relating to Political Entities as defined, herein. A Premium Subscription enables the subscriber “special access” to the candidate(s) meetings and events for those candidate(s) donated to by the Premium Subscriber. By using our “PM Platform,” the website, mobile App and accessing our data, you agree to all these terms.

The following is a list of definitions and terms applicable to this document.

PM Electronic Agreements

  1. Permission Slips A and B- For PM, an electronic form that is agreed to by an authorized party to act on behalf of the Candidate, Campaign Committee, Non-profit organization, qualifying National Committee of a Political Party who can grant permission to publish the ‘private agenda’ for the benefit of Premium Subscribers who are PM donors. The Permission Slip will request permission to make automatic deposits on behalf of donors and will include instructions on the functionality of Stripe (Pay Gateway) as it relates to directing donations. A request is included to input banking details for donation deposits. The Permission Slip will also require an attestation by the election campaign that it agrees to be responsible for examining all contributions received for evidence of illegality and compliance with the FEC and any other applicable governing body.
  2. Online Subscription Registration Form- Form accessible on the PM Platform where a user enters into an agreement to subscribe for services. The Form shall comply with FEC regulations and include the disclaimer that contributions must comply with the federal limits and prohibitions and is not from a prohibited source.
  3. PM Online Donor Registration Form – The form that is automatically generated when a Subscriber on the PM Platform is donating to a candidate requiring answers to specific questions as required by law and then enabling prompts to choose party affiliation, the candidate campaign

TERMS AND DEFINITIONS

Services- The act of providing:

(A)     data on Political Entities and the events and meetings they hold, which are available to the public via the PM Platform.

(B)     Subscribers a way to donate to Candidates who pay for a Premium Political Entity listing and are eligible by law to receive donations based on the PoliticalMeetings.com Privacy Policy and Terms of Service.

(C)     a database where Political Entities can promote their meetings and events for the benefit of PoliticalMeetings.com subscribers.

(D)     a method where Candidates who have completed the process of enrolling as a Premium Political Entity can receive contributions from Premium Subscribers who are eligible donors and who are eligible by law.

  1. Campaign Donation- Donation donated through PoliticalMeetings.com from a Premium Subscriber to a candidate or national party committee.
  2. Campaign Finance refers to rules and regulations by a governmental body regarding fundraising and how funds are handled in an election campaign.
  3. Candidate’s Authorized Committee Representative- A representative who is appointed to conduct business on the Candidate Campaign Committee’s behalf.
  4. Commitment to Cooperate- The agreement of a Premium Meetings Sponsor to provide meetings or event invitations that are not available to the public to Premium Subscribers. This feature is a benefit exclusive to Premium Subscribers.
  5. Pay Gateway Fee—A payment processing fee charged by a Pay Gateway Merchant, such as PayPal, Stripe, or another financial institution that facilitates payment processing.
  6. Administrative Fee- The fee charged by PoliticalMeetings.com for the services it provides to cover the company’s administrative costs.
  7. Political Entity Fee—The fee charged by PoliticalMeetings.com to a Political Entity for either a Basic or Premium Political Entity listing in exchange for services rendered.
  8. Base Rate – The advertised subscription rate.
  9. Subscription agreement between the User of the PoliticalMeetings.com Platform and PoliticalMeetings.com to provide a monthly service that automatically renews and is cancelable at any time.
  10. Subscription Rate- The total monthly amount charged by PoliticalMeetings.com to the Subscriber.
  11. National Committee Donation- A donation to a National Committee of a Political Party recognized by the Federal Elections Commission.
  12. Non-Profit Org. Donation- Donation through PoliticalMeetings.com to a Non-Profit Organization
  13. Donor Dashboard- Premium Subscribers of PoliticalMeetings.com are provided with access to a private dashboard to see any names of candidates they support, and view records of contributions made.
  14. Political Entity Dashboard- A Dashboard where Candidates who are enrolled in a Premium Political Entity listing can log in online to download reports and view donation records.
  15. Donor- The “Premium Subscriber” making the donation who completes and is qualified based on the requirements listed on the Online Donor Registration Form.
  16. Donee- Election Campaign that is enrolled as a Premium Political Entity listing who is legally qualified to accept campaign contributions.
  17. Private Agenda Access—The Platform provides donors who are Premium Subscribers with access to information about meetings or events that are ordinarily not open to the public and are by invitation for donors to those Candidates enrolled a Premium Political Entities.
  18. Election Campaign- a time according to law that precedes an election when politicians try to persuade people to vote for them.

TYPES OF POLITICAL ENTITIES

  1. Candidate Campaign Committee- A political campaign committee designated by a candidate for Congress for purposes of the Federal Election Campaign Act (52 U.S.C. 30102(e), or for a local or state candidate under local or state law and or rather explained as a person running for elected office and appearing on a candidate list released by the government elections agencies.
  2. Incumbent Campaign Committee- A political campaign committee designated by a candidate in a re-election campaign for Congress for purposes of the Federal Election Campaign Act (52 U.S.C. 30102(e), or for a local or state candidate under local or state law and or rather explained as a person who holds political office at the same time they are running for elected office and appearing on a candidate list released by the government elections agencies.
  3. Incumbent- A holder of an office or post that is political.
  4. Non-Profit Organizations—An organization that has completed one IRS 990 form is in active status and holds political meetings or events.
  5. Political Action Committee- An organization that aims to solicit and make political contributions.
  6. Political Club- A membership-based organization. Membership of a political club is an outward show of political allegiance.
  7. Political Committee- Any committee, club, association, or other group, either formally organized or not.
  8. Political Group- A political club is an organization in which members are involved in meetings about working to influence the outcome of elections, political parties’ leadership, or public affairs.
  9. Political Party- The federal campaign finance law defines “political party” as a committee or organization whose nominated or selected candidates for federal office appear on the ballot as the party’s candidates.
  10. Political Party Committee- an organization officially affiliated with a political party registered with the Federal Elections Commission (FEC), which raises and spends money for political campaigning.
  11. State Party Committee- A committee with an official party structure by the bylaws of a political party or by the operation of the state law that has at least one Candidate for federal office whose name appears on the ballot as a candidate of the committee and that has an agreement with the political party to perform activities commensurate with the day-to-day operation of the party at the state level.

 

MEETINGS

  1. Political Meeting- Meetings or events that are political in nature.
  2. Candidate Meet and Greet- An event mainly orchestrated to introduce a political candidate to public citizens.
  3. Open Meeting- A meeting at which the public may be present, which does not require an RSVP.
  4. Kick-off meetings- The first meeting with the project team members.
  5. RSVP Meeting- A Political Meeting or Event requiring an RSVP.
  6. Conference- a formal meeting for discussion, exchange of opinions, or education.
  7. Fundraising Event- An event created to fundraise for a political campaign or charity.
  8. Fundraising Meeting- Meeting to discuss all aspects of fundraising.
  9. Party Convention – A convention held by a political party.
  10. Political Entity Function- Other functions not otherwise defined are held by a political entity as defined by PoliticalMeetings.com.
  11. Precinct Meeting- Precinct caucuses are neighborhood-level meetings hosted by the Democratic and Republican Parties before a Primary Election. The precinct is the most minor subdivision of the county.
  12. Private Agenda- Meetings or events not otherwise open to the public.
  13. Team Building- A meeting you call to build bonds or facilitate collaboration among team members.
 

Customer is a Political Entity, and a Premium Subscriber is an Individual Person who can legally donate to a political candidate.

  1. A Premium Subscriber of the PM Platform may not be a Company or other Entity and must be an individual who can legally donate/contribute to a political candidate who is running an election campaign. Subscribers who subscribe to our Services understand that $1 per month of the total amount collected shall be designated “by the Subscriber” as a contribution/donation to the candidate of choice who can receive donations and is listed on the “PM Platform.” Premium Subscribers may donate to as many candidates as they want. The Premium Subscriber does not incur additional fees from PM if they do not donate to more than three candidates and a choice of one recognized Non-profit organization or a qualifying National Party Committee as recognized by the Federal Election Commission.
  1. Subscribers may contribute/donate to as many candidates as they want. Subscribers may donate $1 (one dollar) to each of three separate candidates without incurring additional fees incurred by the PM Platform. Pay Gateway fees are paid by PoliticalMeetings.com (PoliticalMeetings.com LLC) when you donate to no more than one candidate. When you, the subscriber, donates to more than one candidate, you will incur 100% of any Pay Gateway fees. When a candidate is unable to receive donations, this means that their listing is not a Premium Candidate Profile. Please contact us at (720) 324-4041 for assistance if you have questions about Candidate Profiles and how to access the system.
  1. Events and Meetings listings are provided on our website which is populated through our own company research and are meetings which are also available on the internet to the public on other websites. Please contact us at [email protected] if you believe that a candidate is no longer eligible to be listed as a candidate who is actively seeking election and for any other concerns regarding listings.
  2. Candidates must adhere to local, state, and federal laws. The Candidate must complete a Permission Slip which includes instructions for setting up their Premium Political Entity Listing which allows the Candidate the ability to receive donations/contributions through our website or Mobile App. All Political Entities who want services must pay the respective Political Entity Fee.
  3. Subscribers and Customers (the Political Entities) who use our Services you and/or your entity, political party or other organization agree to all these terms. Your use of our Services is also subject to our Cookie Policy and our Privacy Policy, which covers how we collect, use, share and store your personal information.
  4. You agree that by clicking “Subscribe Now” or by registering, accessing, or using our services, you are agreeing to enter a legally binding contract with “PoliticalMeetings.com LLC.” 7. If you subscribe on behalf of another person or entity unless you are an authorized individual with a Political Entity who is qualified by law as the entity’s representative, you are accessing this database against our policies, and we retain the right to seek any legally permissible remedy if necessary. If you do not agree to this contract (“Contract” or “User Agreement”), do not click “Subscribe Now” (or similar) and do not access or otherwise use any of our Services. If you wish to terminate this contract, at any time you can do so by cancelling and closing your account by sending an email or by another method which is made available through the website. You would automatically no longer have access to or the ability to use our Services.

Platform Security Measures

  • We require location monitoring and do not allow access on our mobile App from outside of the United States to unknown new visitors. We would be monitoring the Platform on the website and mobile App daily and would most often be alerted to any cause for concern which would be reported to the appropriate authorities for appropriate action.
  • Subscriptions can also be cancelled when a candidate’s election campaign is no longer legally permitted to accept donations. It is incumbent upon the election campaign to notify PM. Please note the definitions to follow for candidate and election campaign.
  • The Online Subscription and Donor Registration Forms would have the following disclosures:

Candidate’s Authorized Committee Representative Perspective:

  1. Before the Subscriber can access the platform, the Candidate must upgrade the Political Entity Listing to a Premium Political Entity Listing by completing a Permission Slip and paying a Political Entity Fee for services provided by PM. The main difference between Political Entity Listing and Premium Political Entity Listing is that the Candidate is providing the data necessary for the PM Platform to facilitate donations to its campaign on behalf of our subscribers and by doing so can also provide by email on a regular basis a list of special events that are only for donors to the campaign. PM will make those meetings and invitations available via access to the PM Database exclusively to those who donate to the respective candidates that have a Premium Political Entity Listing.
  2. Administrative personnel with PM emails a link or provides instruction on how to access an online form so that the Candidate Campaign Committee can access, review, and then complete the Permission Slip. Upon completion, the Prospective Candidate must pay for the Political Entity Fee and upon successful payment is converted to a Premium Political Entity Listing and will be provided instructions on setting up the Pay Gateway used to facilitate donations, instructions on how to access the dashboard, a commitment to cooperate and other general terms and conditions. The cost to the candidate will be usual and normal based on the type of service provided by PM.
  3. Candidate can invite voters to participate with PM’s Platform and can share its profile.
  4. Candidate can invite those members by email with instructions on how to become a PM Subscriber.
  5. Candidate does not currently have any control over the information on the campaign’s page and would complete a form or email PM with any information it would like published or information on meetings or fundraisers.
  6. Candidate would be able to share a link to its website which would likely have a donation button. This is not a problem for PM since we have already earned our fee from the user.
  7. Any person who wants to donate to the Candidate may do subject to government law and FEC Regulations.

PM will verify the legal contribution limits per cycle and office held when applicable. We realize that this is an important record keeping aspect to comply with Federal, State and any local regulations.

The electronic form will require the following

  1. Legal name
  2. Mailing address
  3. Occupation and Employer
  4. Whether or not they are a federal contractor
  5. Attest that whether they are a US citizen or legal permanent resident
  6. That they are using their own personal funds to make the contribution and not using funds given to them by another person for the purpose of contribution
  7. That they are using their own credit card and not a corporate or business card, or a card issued to another person
  8. That they are over the age of 18 and they are not a minor
  9. That the contribution is not being made at the request or direction of another individual

*The PM Platform provides encryption which hides all sensitive information from our database including passwords and credit card or other information used in making payments.

This Contract applies to “PoliticalMeetings.com LLC”-branded apps, “PoliticalMeetings.com LLC” Learning and other “PoliticalMeetings.com LLC”-related sites, apps, communications, and other services that state that they are offered under this Contract (“Services”), including the offsite collection of data for those Services, such as our ads and the “Apply with “PoliticalMeetings.com LLC” and “Share with “PoliticalMeetings.com LLC” plugins. Registered users of our Services are “Subscribers” and unregistered users are “Visitors”. This Contract applies to both Subscribers, Visitors, and all other users of the PM Platform.

“PoliticalMeetings.com LLC”

You are entering into this Contract with “PoliticalMeetings.com LLC” (also referred to as “we” and “us”). If you reside outside of the United States, you are entering into this Contract with “PoliticalMeetings.com LLC” (“PoliticalMeetings.com LLC”) will be the controller of you and/or your entity’s, or other organization’s personal data provided to, or collected by or for, or processed in connection with our Services. Colorado, USA will be the jurisdiction for governing law and all legal concerns and questions. Denver courts are the agreed-upon venue. This Contract applies to Members and Visitors.

As a Visitor, Subscriber, or Donor who uses our services, the collection, use, and sharing of your and/or your entity’s, political parties, or other organization’s personal data is subject to this Privacy Policy (which includes our and other documents referenced in this Privacy Policy) and updates.

1.2 User Roles

Visitors

Visitors receive free, limited access to basic information in the PoliticalMeetings.com Database. They can choose between two categories: Political Entity Type or Meeting/Event Type. Search results include the name or title, political affiliation, and the county and state of the entity, but not the complete address.

Subscribers

Both Basic and Premium Subscribers can view information about all Political Entities, regardless of their political affiliation. If a Political Entity has publicly available information about meetings or events, both types of subscribers will have access to that information.

The key difference between Basic and Premium Subscribers is the level of access to information in the PoliticalMeetings.com Database. Basic Subscribers have access to limited publicly available information, while Premium Subscribers can access a significantly larger amount of information, including calendar links (when available) and links to other websites, such as advertisements for special events and fundraisers.

Customers

Political Entities who pay a Political Entity Fee in exchange for services are considered customers of PoliticalMeetings.com.

1.3 Change

We may make changes to the Contract.

We may modify this Contract, our Privacy Policy, and our Cookies Policies from time to time. If we make material changes to them, we will provide you with notice through our Services, or by other means, to provide you with the opportunity to review the changes before they become effective. We agree that changes cannot be retroactive. If you object to any changes, you may close you and/or your entity’s, political parties, or other organization’s account. You continued use of our Services after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms.

2.1 Service Eligibility

Here are some promises that you make to us in this Contract:

You’re eligible to enter this Contract and you are at least our “Minimum Age.”

The Services are not for use by anyone under the age of 18.

To use the Services, any entity eligible for services according to the policies and procedures, and-or you as an individual agree that: (1) you must be the “Minimum Age” (described below) or older; (2) you will only have one “PoliticalMeetings.com LLC” account, which must be in your real entity or personal name; and (3) you or the entity you represent are not already restricted by “PoliticalMeetings.com LLC” from using the Services. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 18.

“Minimum Age” means 18 years old. However, if the law requires that you must be older for “PoliticalMeetings.com LLC” to lawfully provide the Services to you without parental consent (including using your personal data) then the Minimum Age is such older age.

Any representative of an approved organization may be under the age of 18 (eighteen) if he or she is delegated the official responsibility and provided permission by the organization to enter into this agreement.

2.2 Your Account

You will keep your or your organizations, entities, or political party’s affiliated account password a secret.

You will not share the account information with anyone else and will follow our rules and the applicable law.

Subscribers and/or Customers are account holders. You agree to (1) try to choose a strong and secure password; (2) keep your password secure and confidential; (3) not transfer any part of your account (e.g., connections) and (4) follow the applicable law and our list of Dos and Don’ts and Professional Community Policies listed below. You are responsible for anything that happens through your account unless you or the political party you are affiliated with makes the choice to close it or report misuse.

As between you and others (including your employer or political party affiliate), your account belongs to you who, or the political party office which subscribes to our service or services. Professional Community Policies: Our meetings postings are to be for professional and or political purposes, only. PoliticalMeetings.com in its sole discretion may not publish or be required to publish content or meetings data or engage in or provide a Service which focuses on non-political or mixed-political/non-political issues or agenda. PoliticalMeetings.com reserves the right to remove content that is not respectful to others. Any content on behalf of a political leader, candidate, advisor, representative, and/or the public is not to be misunderstood as the opinion of PoliticalMeetings.com LLC. Those opinions are from the person or entity who posted or commented regarding the subject, not those of “PoliticalMeetings.com LLC.

2.3 Payment

You, the Subscriber may cancel at any time upon notice by sending an email to [email protected]. Subscribers choosing the Basic Subscriber plan will pay $4.98 per month for access. Premium Subscriber will pay $6.98 per month unless donations are made to more than one candidate. All donations are $1 for each candidate. Subscribers understand that taxes may be added subject to the state or jurisdiction you reside in. The subscriber does not incur additional fees from PM if they do not donate to more than three candidates and a choice of one Non-profit organization, and an FEC qualifying National Party Committee. The Premium Subscription rate is $6.98 per month. This amount includes $5.98 in administrative fees to cover operational costs and a $1.00 donation to a Premium Political Entity. Premium Subscribers can choose to contribute an additional $1.00 to as many Premium Political Entities as they wish, resulting in an increase in their subscription price for each donation. Furthermore, Premium Subscribers will incur an additional administrative fee for every three Premium Political Entities they contribute to. Subscribers may cancel at any time by contacting the office by email or telephone; however, it is recommended that the subscriber cancel by email so that the cancellation is in writing. Visitors are not subscribers and are not required to complete a Subscription Registration Form and have limited access. Political Entities can request to have a free profile providing very limited information to PM Subscribers. Requests may be submitted to [email protected] and in the subject line “Free Listing” should be stated. Customers and Subscribers shall be bound by this and a separate agreement together and the separate agreement shall reference these terms and conditions/privacy policy.

Refunds are not automatic. See below.

If you buy any of our paid Services, you agree to pay us the applicable fees and taxes and additional terms specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services.

Also, you agree that:

Although the (“PM Platform”) has encryption meaning that as a company, we cannot see your passwords and credit card payment information, we will use a third party for payment. We use Stripe who may store and continue billing your payment method (e.g., credit card) even after it has expired if you are on a subscription plan. Most of our payment options are one-time fees or subscription-based plans for services. You agree on behalf of your organization or yourself personally that there may be fees and taxes applicable which may or may not be included as part of the price displayed on the website or other application including any mobile application. To avoid future charges, cancel before the renewal date.

All your purchases of Services are subject to the “PoliticalMeetings.com LLC” refund policy.

We may calculate taxes payable by you based on the billing information that you provide us at the time of purchase.

2.4 Notices and Messages

You are agreeable to us providing notices and messages to you through our websites, apps, and contact information. If your contact information is out of date, you may miss out on important notices.

You agree that we will provide notices and messages to you in the following ways: (1) within the Service, or (2) sent to the contact information you provided us (e.g., email, mobile number, physical address). You agree to keep your contact information up to date.

2.5 Sharing

When you share information on our Services, others can see, copy and use that information, we are not obligated to publish any information or content on our Service and can remove it at our sole discretion, with or without notice.

3.1. Your License to “PoliticalMeetings.com LLC”

You own all the content, feedback, and personal information you provide to us, but you also grant us a non-exclusive license to use it.

As between you and “PoliticalMeetings.com LLC”, you own the content and information that you submit or post to the Services, and you are only granting “PoliticalMeetings.com LLC” and any affiliates the following non-exclusive license:

A worldwide, transferable, and sublicensable right to use, copy, modify, distribute, publish, and process, information, and content that you provide through our Services and the services of others, without any further consent, notice, and/or compensation to you or others. These rights are limited in the following ways:

You can end this license for specific content by deleting such content from the Services, or generally by closing your account, except (a) to the extent you shared it with others as part of the Service and they copied, re-shared it, or stored it and (b) for the reasonable time it takes to remove from backup and other systems.

We will not include your content in advertisements for the products and services of third parties to others without your separate consent (including sponsored content). However, we have the right, without payment to you or others, to serve ads near your content and information, and your social actions may be visible and included with ads, as noted in the Privacy Policy.

Learn More

While we may edit and make format changes to your content (such as translating it, modifying the size, layout, file type, or removing metadata), we will not modify the meaning of your expression.

Because you own your content and information and we only have non-exclusive rights to it, you may choose to make it available to others.

You and “PoliticalMeetings.com LLC” agree that if the content includes personal data, it is subject to our Privacy Policy. You also agree that you are 18 (eighteen) years or older and legally able to enter into an agreement.

You and “PoliticalMeetings.com LLC” agree that we may access, store, process, and use any information and personal data that you provide in accordance with the terms of the Privacy Policy and your choices (including settings).

By submitting suggestions or other feedback regarding our Services to “PoliticalMeetings.com LLC”, you agree that “PoliticalMeetings.com LLC” can use and share (but does not have to) such feedback for any purpose without compensation to you. You promise to only provide information and content that you have the right to share, and that your “PoliticalMeetings.com LLC” profile will be truthful. You agree to only provide content or information that does not violate the law nor anyone’s rights (including intellectual property rights). You also agree that your profile information will be truthful. “PoliticalMeetings.com LLC” may be required by law to remove certain information or content in certain countries.

3.2 Service Availability

We may change, suspend, or end any Service, or change and modify prices prospectively at our discretion. To the extent allowed under applicable law, these changes may be effective upon notice provided to you.

We may change or discontinue any of our Services. We don’t promise to store or keep showing any information and content that you’ve posted.

“PoliticalMeetings.com LLC” is not a storage service. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.

3.3 Other Content, Sites, and Apps

Your use of others’ content and information posted on our Services is at your own risk.

Others may offer their own products and services through our Services, and we aren’t responsible for those third-party activities.

By using the Services, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive, or otherwise harmful. “PoliticalMeetings.com LLC” generally does not always review content provided by candidates or others. You agree that we are not responsible for others’ content or information. We cannot always prevent this misuse of our Services, and you agree that we are not responsible for any such misuse. You also acknowledge the risk that you or your organization may be mistakenly associated with content about others when we let connections and followers know you or your organization were mentioned in the news.

You are responsible for deciding if you want to access or use third-party apps or sites that link from our Services. If you allow a third-party app or site to authenticate you or connect with your “PoliticalMeetings.com LLC” account, that app or site can access information on “PoliticalMeetings.com LLC” related to you and your connections.
